1. 1. EGift Cards; CustomCanineUnlimited.com Balance; Redemption.
      CustomCanineUnlimited.com EGift Cards are issued by Custom Canine Unlimited, LLC, a Georgia limited liability company. They include CustomCanineUnlimited.com EGift Cards that are automatically added to your CustomCanineUnlimited.com Balance when you purchase or receive a CCU eGift Card (“EGift Cards“). Your CustomCanineUnlimited.com Balance displays the total remaining balance of all EGift Cards applied to your CustomCanineUnlimited.com account but not yet applied to a purchase. We may refer to your CustomCanineUnlimited.com Balance as your “CCU Balance,” or “EGift Card balance.” To view your CustomCanineUnlimited.com Balance, visit Your eGift Card Account on CustomCanineUnlimited.com. Purchases are deducted from your CustomCanineUnlimited.com Balance. Any unused CustomCanineUnlimited.com Balance will remain associated with your CustomCanineUnlimited.com account. If a purchase exceeds your CustomCanineUnlimited.com Balance, the remaining amount must be paid with another payment method.EGift Cards may only be redeemed to purchase eligible goods and services provided on CustomCanineUnlimited.com. Eligible goods and services are subject to change at our sole discretion. Your CustomCanineUnlimited.com Balance EGift Cards cannot be reloaded; resold; used for payment outside of www.CustomCanineUnlimited.com; used for unauthorized advertising, marketing, sweepstakes, promotional or commercial purposes, including to facilitate the resale or shipment of goods from CustomCanineUnlimited.com; redeemed for more than face value; transferred for value; redeemed for cash; returned for a cash refund (except to the extent required by law), or used in a manner otherwise prohibited by our CustomCanineUnlimited.com EGift Card Restrictions and Prohibited Activities policy. No portion of your CustomCanineUnlimited.com Balance may be transferred to another CustomCanineUnlimited.com account. Neither your CustomCanineUnlimited.com Balance nor your EGift Cards may be applied to purchasing goods or services at any Custom Canine Unlimited Affiliated property outside of the United States.

1. 1. Risk of Loss.
      The risk of loss and title for EGift Cards passes to the purchaser upon our electronic transmission of the EGift Card to the purchaser or designated recipient or our delivery to the carrier, whichever is applicable. EGift Cards must be obtained from Custom Canine Unlimited or an authorized third party, and you are responsible for safeguarding your CustomCanineUnlimited.com Balance or EGift Card from unauthorized use. We are not responsible if any EGift Card is lost, stolen, or destroyed or if your CustomCanineUnlimited.com Balance or any EGift Card is used without your permission. There are a variety of EGift Card scams that request payment by EGift Card. Custom Canine Unlimited is not responsible for and assumes no liability to you for any unlawful conduct or fraud by any third party associated with any EGift Card.

1. 1. Use of CustomCanineUnlimited.com Balance or any EGift Card in Violation of these Terms and Conditions.
      By using an EGift Card, you agree to comply with these terms and conditions and not to use an EGift Card in any manner that is misleading, deceptive, unfair, or otherwise harmful to CustomCanineUnlimited.com, its affiliates, or its customers. We reserve the right, without notice to you, to void EGift Cards (including as a component of your CustomCanineUnlimited.com Balance) without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if we suspect that an EGift Card is obtained, used, or applied to a CustomCanineUnlimited.com account (or your CustomCanineUnlimited.com Balance is applied to purchase) fraudulently, unlawfully, or otherwise in violation of these terms and conditions.

1. 1. Limitation of Liability.
      TO THE FULL EXTENT PERMISSIBLE BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, CONCERNING EGIFT CARDS OR YOUR CUSTOMCANINEUNLIMITED.COM BALANCE, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULL EXTENT PERMISSIBLE BY LAW, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY AND OUR SOLE LIABILITY WILL BE THE REPLACEMENT OF THAT EGIFT CARD.

1. 1. Disputes.
      Any dispute or claim relating to EGift Cards or your CustomCanineUnlimited.com Balance will be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The U.S. Federal Arbitration Act and U.S. federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow these terms and conditions as a court would. To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent: Boyd Jones, 639 Whitlock Ave SW, Marietta, GA 30064. The American Arbitration Association (“AAA“) will conduct the arbitration under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available at www.adr.org or by calling 1-800-778-7879. The AAA’s rules will govern the payment of all filing, administration, and arbitrator fees. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the lawsuits are frivolous. Likewise, we will not seek attorney’s fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person at a mutually agreed location.You and we agree that any dispute resolution proceedings will be conducted only individually and not in a class, consolidated or representative action. If for any reason, a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We agree that you or we may bring suit in court to enjoin infringement or another misuse of intellectual property rights.
   2. General Terms.
      The CustomCanineUnlimited.com Conditions of Use apply. No fees apply to EGift Cards. We reserve the right to require additional verification of your identity, EGift Card, account ownership, or provision of a different payment instrument before applying an EGift Card to your account or your CustomCanineUnlimited.com Balance to a purchase. When you purchase, receive, or use an EGift Card to your account or your CustomCanineUnlimited.com Balance to purchase, you agree that the laws of the State of Georgia, without regard to principles of conflict of laws, will govern these terms and conditions and any dispute that may arise between you and Custom Canine Unlimited, LLC, and its affiliates related to your use of an EGift Card or your CustomCanineUnlimited.com Balance. We reserve the right to change these terms and conditions without notice from time to time at our sole discretion. All terms and conditions apply to the extent permitted by law. Suppose these terms and conditions are deemed invalid, void, or unenforceable. In that case, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.

1. CustomCanineUnlimited.com Balance Expiration.
   The portion of your CustomCanineUnlimited.com Balance made up of EGift Cards issued after 12,1, 2020, does not expire.
