At Custom Canine Unlimited, LLC, we care about the privacy of your data and are committed to protecting it. This Privacy Policy explains what information we collect about you and why, what we do with that information, and how we handle that information. We’ll also explain what choices you have with respect to the information.

Applicability Of This Privacy Policy

This Privacy Policy applies to Custom Canine Unlimited, LLC training, services, and products (collectively, the “Products”), CustomCanineUnlimited.com and other Custom Canine Unlimited, LLC websites (collectively, the “Sites”) and other interactions (e.g., customer service inquiries, user conferences, etc.) you may have with Custom Canine Unlimited, LLC. If you do not agree with the terms, do not access or use the Products, Sites or any other aspect of Custom Canine Unlimited, LLC’s business.

This policy applies to the Company’s employees, contractors, and officers.

The Company has a contract with all Data Processors that it uses in compliance with Article 28 & Article 29 of the GDPR, and ensures that all Data Processors are compliant with Data Protection Legislation.

The policy does not apply to third party services. Where third party services are used, and the third party is not a Data Processor, no Relevant Data (as defined below) is shared with them, or the Relevant Data has been anonymized such that the GDPR does not apply. Information collected by third parties is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.

In addition, a separate agreement governs delivery, access and use of the Products (the “User Agreement”).

This policy applies to Relevant Data received and processed only.

Capitalized terms used in this Policy and not otherwise defined shall have the meanings provided below:

Relevant Data – Personal Data and Special Categories of Data are the Relevant Data covered by this policy and as defined in the Data Protection Legislation.

Special Categories of Data – Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, bio metric data and data concerning health or a person’s sex life or sexual orientation.

Processing/Processed – any operation on personal data, whether automated or not.

Information We Collect and Receive

When you interact with our Sites and Products, we collect Information that, alone or in combination with other data, could be used to identify you (Personal Data). Some of the Information we collect is stored in a manner that cannot be linked back to you (Non-Personal Data).

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Payments Information

Payments information provided by you via the Sites will be stored and processed by Square, Inc. and any other third party service providers as designated by us from time to time. We will collect certain information on the Sites required for Square, Inc. and such third party services providers to process payments, including credit / debit card numbers, security numbers and other related payment information. All such information is subject to the privacy policy of Square, Inc. (available here https://squareup.com/legal/privacy ) or any other third party service provider as applicable.

Usage Information

Certain data about the devices you use to connect with Custom Canine Unlimited, LLC and your use of the Sites and/or Products are automatically logged in our systems, including:

Custom Canine Unlimited, LLC may receive data about Site visitors, marketing campaigns, and other matters related to our business from affiliates and subsidiaries, our partners or others that we use to make our own information better or more useful. This data may be combined with Other Information we collect and might include aggregate level data, such as which IP addresses correspond to zip codes or countries. Or it might be more specific: for example, how well an online marketing or email campaign performed.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

Additional Information Provided to Custom Canine Unlimited, LLC

We receive Other Information when submitted to our Sites or if you participate in a focus group, contest, activity or event, apply for a job, request support, interact with our social media accounts or otherwise communicate with Custom Canine Unlimited, LLC.

Collection Information From Children

Custom Canine Unlimited, LLC does not knowingly collect personal information from children under the age of 1. If we determine we have collected personal information from a child younger than 17 years of age, we will take reasonable measures to remove that information from our systems. Using Your Information by Custom Canine Unlimited, LLC

Custom Canine Unlimited, LLC does not share your Personal Data with third parties for the purpose of enabling them to deliver their advertisements to you.

Custom Canine Unlimited, LLC does not sell or rent your Personal Data.

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. Klarna then responds with a unique transaction ID.This ID is stored in the order in WooCommerce for future reference.

We collect information about visitors who comment on Sites that use our Akismet anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

What personal data we collect and why we collect it

Event, Attendee, and Ticket Purchaser Information

If you create, submit, import, save, or publish event ticket information, as well as obtain RSVPs or purchase tickets to events, such information is retained in the local database:

  1. Attendees information (RSVPs and REGISTRATION): name and email address
  2. Ticket information (RSVPs and REGISTRATION): name, email address, and ticket number/SKU (via check-in page)
  3. Ticket purchaser information: name and email address
  4. Ticket purchaser billing address, which is collected through the use of WooCommerce, Easy Digital Downloads, or PayPal

Please note: The website owner can collect nearly any Attendee Information requested from ticket buyers by creating a custom registration form.

Event, Venue, and Organizer Information

If you create, submit, import, save, or publish Event, Venue, or Organizer information, such information is retained in the local database:

  1. Venue information: name, address, city, country, state, postal code, phone, website, geographical coordinates (latitude and longitude)
  2. Organizer information: name, phone, website, email
  3. Event information: website, cost, description, date, time, image

Importing Events, Venues, and Organizers:

  1. All data present within a CSV or ICS file and external URLs (for events, venues, organizers, and tickets)
  2. Import origin data (URL from where events are being imported—such as Eventbrite, MeetUp, other compatible URL sources, and more, which can include similar or same data as listed above)
  3. Eventbrite Ticket information: name, description, cost, type, quantity

Please note that to create new events through the Community Events submission form, a user must hold a website account on this domain. This information is retained in the local database. It is also possible to create events anonymously, if the site owner has this option enabled.

When purchasing Eventbrite Tickets, attendee, purchaser, and order information are stored and managed by Eventbrite.

API Keys

We make use of certain APIs, in order to provide specific features.

These APIs may include the following third party services: Google Maps (API key), Meetup (OAuth token), PayPal (email, Client ID, Client Secret), Eventbrite (API key, auth URL, Client Secret), and Zoom (email, Client ID, Client Secret).

How long we retain your data

Subscriber information is retained in the local database indefinitely for analytic tracking purposes and for future export.

Data will be exported or removed upon users request via the existing Exporter or Eraser.

If syncing data to a 3rd party service (for example Mailchimp), data is retained there until unsubscribed or deleted.

Where we send your data

Popup Maker does not send any user data outside of your site by default.

If you have extended our subscription forms to send data to a 3rd party service such as Mailchimp, user info may be passed to these external services. These services may be located abroad.

By providing your cell phone number, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., SMS/MMS cart reminders, sale notices, etc) from Custom Canine Unlimited, LLC. These messages include text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. You give Custom Canine Unlimited, LLC permission to send text messages to the enrolled cell phone number through your wireless phone carrier, unless and until you end permission per these Terms & Conditions. Consent to receive automated marketing text messages is not a condition of any purchase. Message & Data rates may apply.

Message frequency may vary. Custom Canine Unlimited, LLC reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, YOU AGREE THAT IN NO EVENT SHALL EITHER OF Custom Canine Unlimited, LLC OR ANY PARTY ACTING ON BEHALF OF Custom Canine Unlimited, LLC BE LIABLE FOR: (A) ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AGGREGATE AMOUNT EXCEEDING THE GREATER OF THE AMOUNT YOU PAID TO Custom Canine Unlimited, LLC HEREUNDER OR $100.00; OR (B) ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR ANY OTHER DAMAGES. YOU AGREE EVEN IF Custom Canine Unlimited, LLC HAS BEEN TOLD OF POSSIBLE DAMAGE OR LOSS ARISING OR RESULTING FROM OR IN ANY WAY RELATING TO YOUR USE OF THE Custom Canine Unlimited, LLC MESSAGING PROGRAM. Custom Canine Unlimited, LLC AND ITS REPRESENTATIVES ARE NOT LIABLE FOR THE ACTS OR OMISSIONS OF THIRD PARTIES, INCLUDING BUT NOT LIMITED TO DELAYS OR NON-DELIVERY IN THE TRANSMISSION OF MESSAGES.

Indemnity
To the maximum extent allowed by applicable law, you agree to indemnify, defend and hold harmless Custom Canine Unlimited, LLC, its directors, officers, employees, servants, agents, representatives, independent contractors and affiliates from and against any and all claims, damages, liabilities, actions, causes of action, costs, expenses, including reasonable attorneys’ fees, judgments or penalties of any kind or nature arising from or in relation to the these Messaging Terms or your receipt of text messages from Custom Canine Unlimited, LLC or its service providers.

Dispute Resolution

General. Any dispute or claim arising out of or in any way related to these Messaging Terms or your receipt of text messages from Custom Canine Unlimited, LLC or its service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a dispute or claim arises will be resolved by binding arbitration. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE MESSAGING TERMS, YOU AND Custom Canine Unlimited, LLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THESE MESSAGING TERMS SHALL BE SUBJECT TO AND GOVERNED BY ARBITRATION.

Exceptions. Notwithstanding subsection (a) above, nothing in these Messaging Terms will be deemed to waive, preclude, or otherwise limit the right of you or Custom Canine Unlimited, LLC to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in aid of arbitration from a court of competent jurisdiction; or (iv) file suit in a court of law to address an intellectual property infringement claim.

Arbitrator. Any arbitration between you and Custom Canine Unlimited, LLC will be governed by the JAMS, under the Optional Expedited Arbitration Procedures then in effect for JAMS, except as provided herein. JAMS may be contacted at www.jamsadr.com. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.

No Class Actions. YOU AND Custom Canine Unlimited, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Custom Canine Unlimited, LLC agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. You agree that, by agreeing to these Messaging Terms, you and Custom Canine Unlimited, LLC are each waiving the right to a trial by jury or to participate in a class action, collective action, private attorney general action, or other representative proceeding of any kind.

Modifications to this Arbitration Provision. Notwithstanding anything to the contrary in these Messaging Terms, if Custom Canine Unlimited, LLC makes any future change to this arbitration provision, you may reject the change by sending us written notice within 30 days of the change to Custom Canine Unlimited, LLC’s contact information provided in the “Contact Us” section below, in which case this arbitration provision, as in effect immediately prior to the changes you rejected, will continue to govern any disputes between you and Custom Canine Unlimited, LLC.

Enforceability. If any provision of these Messaging Terms is found to be unenforceable, the applicable provision shall be deemed stricken and the remainder of these Messaging Terms shall remain in full force and effect.

Changes to the Messaging Terms
We reserve the right to change these Messaging Terms or cancel the messaging program at any time. By using and accepting messages from Custom Canine Unlimited, LLC after we make changes to the Messaging Terms, you are accepting the Messaging Terms with those changes. Please check these Messaging Terms regularly.

Entire Agreement/Severability
These Messaging Terms, together with any amendments and any additional agreements you may enter into with us in connection herewith, will constitute the entire agreement between you and Custom Canine Unlimited, LLC concerning the Messaging Program.

Data storage, transfer, retention, and deletion

Data Storage and Transfers

Information submitted to Custom Canine Unlimited, LLC will be transferred to, processed, and stored in the United States. When you use the Products on your computing device, user content you save will be stored locally on that device and synced with our servers. If you post or transfer any Information to or through our Sites and/or Products, you are agreeing to such information, including Personal Data and user content, being hosted and accessed in the United States.

Duration of Information Storage

You can remove your Personal Data from Custom Canine Unlimited, LLC at any time by emailing us with the respective request: info@customcanineunlimited.com. However, we may keep some of your Personal Data for as long as reasonably necessary for our legitimate business interests, including fraud detection and prevention and to comply with our legal obligations including tax, legal reporting, and auditing obligations.
