At Custom Canine Unlimited, LLC, we care about the privacy of your data and are committed to protecting it. This Privacy Policy explains what information we collect about you and why, what we do with that information, and how we handle that information. We’ll also explain what choices you have concerning the information.

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. Applicability Of This Privacy Policy

This Privacy Policy applies to Custom Canine Unlimited, LLC training, services, and products (collectively, the “Products”), CustomCanineUnlimited.com and other Custom Canine Unlimited, LLC websites (collectively, the “Sites”), and other interactions (e.g., customer service inquiries, user conferences, etc.) you may have with Custom Canine Unlimited, LLC. If you disagree with the terms, do not access or use the Products, Sites, or any other aspect of Custom Canine Unlimited, LLC’s business.

This Policy applies to the Company’s employees, contractors, and officers.

The Company has a contract with all Data Processors it uses in compliance with Article 28 & Article 29 of the GDPR. It ensures that all Data Processors are compliant with Data Protection Legislation.

The Policy does not apply to third-party services. Where third-party services are used, and the third party is not a Data Processor, no Relevant Data (as defined below) is shared with them, or the Relevant Data has been anonymized such that the GDPR does not apply. Their privacy practices govern information collected by third parties. We encourage you to learn about the privacy practices of those third parties.

In addition, a separate agreement governs the delivery, access, and use of the Products (the “User Agreement”).

This Policy applies to Relevant Data received and processed only.

Special Categories of Data – Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, and data concerning health or a person’s sex life or sexual orientation.

Processing/Processed – any operation on personal data, whether automated or not.

Information We Collect and Receive

When you interact with our Sites and Products, we collect Information that, alone or in combination with other data, could be used to identify you (Personal Data). Some of the Information we collect is stored in a manner that cannot be linked back to you (Non-Personal Data).

When visitors leave comments on the Site, we collect the data shown in the comments form and the visitor’s IP address and browser user agent string to help with spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors can download and extract any location data from images on the website.

Payments Information

When you place an order on the website with Klarna Payments as the chosen payment method, information about the products in the order (name, price, quantity, SKU) is sent to Klarna with your billing and shipping address. Klarna then responds with a unique transaction ID, which is stored in the order in WooCommerce for future reference.

Usage Information

Specific data about the devices you use to connect with Custom Canine Unlimited, LLC, and your use of the Sites or Products are automatically logged in our systems, including:

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can automatically recognize and approve any follow-up comments instead of holding them in a moderation queue.

Custom Canine Unlimited, LLC collects phone numbers to contact the owner of the phone number by call and by text. The Custom Canine Unlimited mobile message service (the “Service”) is operated by Custom Canine Unlimited (“Custom Canine Unlimited”, “we”, or “us”). Your service use constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or its features without notice. To the extent permitted by applicable law, we may modify these Mobile Terms at any time. Your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Custom Canine Unlimited’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Custom Canine Unlimited through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program to make any purchases, and your consent is not a condition of any purchase with Custom Canine Unlimited. Your participation in this program is entirely voluntary.

Akismet

We collect information about visitors who comment on Sites that use our Akismet anti-spam service. The information we collect depends on how the User sets up Akismet for the Site but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter, such as their name, username, email address, and the comment itself).

Event, Attendee, and Ticket Purchaser Information

If you create, submit, import, save, or publish event ticket information, as well as obtain RSVPs or purchase tickets to events, such information is retained in the local database:

  1. Attendees’ information (RSVPs and Tickets): name and email address
  2. Ticket information (RSVPs and Tickets): name, email address, and ticket number/SKU (via check-in page)
  3. Ticket purchaser information: name and email address
  4. Ticket purchaser billing address, which is collected through the use of WooCommerce, Easy Digital Downloads, or PayPal

Please note: The website owner can collect nearly any Attendee Information requested from ticket buyers by creating a custom registration form.

Event, Venue, and Organizer Information

If you create, submit, import, save, or publish Event, Venue, or Organizer information, such information is retained in the local database:

  1. Venue information: name, address, city, country, state, postal code, phone, website, geographical coordinates (latitude and longitude)
  2. Organizer information: name, phone, website, email
  3. Event information: website, cost, description, date, time, image

Importing Events, Venues, and Organizers:

  1. All data present within a CSV or ICS file and external URLs (for events, venues, organizers, and tickets)
  2. Import origin data (URL from where events are being imported—such as Eventbrite, MeetUp, other compatible URL sources, and more, which can include similar or the same data as listed above)
  3. Eventbrite Ticket information: name, description, cost, type, quantity

Please note that a user must hold a website account on this domain to create new events through the Community Events submission form. This information is retained in the local database. It is also possible to create events anonymously if the site owner has this option enabled.

When purchasing Eventbrite Tickets, attendee, purchaser, and order information are stored and managed by Eventbrite.

Subscriber information is retained in the local database indefinitely for analytic tracking purposes and future export.

Upon user request, data will be exported or removed via the existing Exporter or Eraser.

If syncing data to a 3rd party service (Mailchimp), data is retained until unsubscribed or deleted.

Where do we send your data

Popup Maker does not send user data outside your Site by default.

If you have extended our subscription forms to send data to a 3rd party service such as Mailchimp, user info may be passed to these external services. These services may be located abroad.

Indemnity

Arbitrator. Any arbitration between you and Custom Canine Unlimited, LLC will be governed by the JAMS, under the Optional Expedited Arbitration Procedures then in effect for JAMS, except as provided herein. The arbitrator has exclusive authority to resolve any dispute relating to this binding arbitration agreement’s interpretation, applicability, or enforceability.

No Class Actions. YOU AND Custom Canine Unlimited, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless you and Custom Canine Unlimited, LLC agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. You agree that, by agreeing to these Messaging Terms, you and Custom Canine Unlimited, LLC are each waiving the right to a trial by jury or to participate in a class action, collective action, private attorney general action, or another representative proceeding of any kind.

Notwithstanding anything to the contrary in these Messaging Terms, if Custom Canine Unlimited, LLC makes any future change to this arbitration provision, you may reject the change by sending us written notice within 30 days of the change to Custom Canine Unlimited, LLC’s contact information provided in the “Contact Us” section below, in which case this arbitration provision, as in effect immediately before the changes you rejected, will continue to govern any disputes between you and Custom Canine Unlimited, LLC.

Enforceability. Suppose any provision of these Messaging Terms is found unenforceable. In that case, the applicable provision shall be deemed stricken, and the remainder of these Messaging Terms shall remain in full force and effect.
